Criminal Defense  Consulting for Attorneys

Former Prosecutorial Perspective. Defense-Focused Execution. (Why Defend When You Can Outmaneuver?)

High-stakes criminal defense cases demand more than hard work. They call for a strategy informed by experience on both sides of the courtroom. Attorney Ashleigh D. Landers brings more than 20 years of experience in both prosecution and criminal defense to consulting services designed to help defense attorneys in the Fairfax and surrounding areas strengthen case strategy, anticipate prosecutorial tactics, and identify opportunities that may otherwise be overlooked.

Criminal defense is not only about responding to the government’s case. It is about understanding how the case was built, anticipating what the prosecution may do next, and identifying opportunities before they are lost.

Ashleigh can help defense attorneys evaluate how a prosecutor is likely to approach a case, what arguments they may prioritize, where they may feel vulnerable, and how they are likely to assess leverage during negotiations or trial preparation.

Some lawyers bring Ashleigh and her team in for focused, behind-the-scenes guidance. Others rely on Ashleigh for deeper involvement in motion practice, discovery analysis, plea negotiations, or investigative coordination. Her team’s role adapts to the needs of the case and the preferences of counsel. In all cases bringing a former prosecutor’s perspective to the defense – not to replace the judgement of lead counsel, but to add another way of seeing the case.  The goal is practical: help the defense see more, prepare earlier, and make strategic decisions with a clearer understanding of how the government is likely to respond.

Whether you are handling a serious felony matter, managing a difficult evidentiary issue, or simply want an experienced second set of eyes on a complex case, Ashleigh and her team can provide practical support designed to strengthen your position at every stage of litigation.  She helps attorneys consider questions such as:

  • How is the prosecutor likely to view the evidence?
  • Which facts will matter most to the government?
  • Where may the prosecution feel vulnerable?
  • What argument is most likely to create meaningful pressure?
  • Is there evidence that should exist but has not been produced?
  • Could a motion expose a weakness—or unintentionally help the government repair its case?
  • What leverage may exist during charging, plea negotiations, or trial preparation?

Motion Strategy and Ghostwriting

A well-timed motion can change the direction of a criminal case. A poorly timed motion can educate the prosecution, reveal the defense strategy too early, or give the government an opportunity to correct a problem.

Ashleigh assists defense attorneys by drafting and ghostwriting motions specific to the facts, procedural posture, and strategic realities of each matter.  Her prosecutorial background helps her evaluate:

  • How the government is likely to respond;
  • Which arguments may create genuine concern;
  • Where the prosecution’s position may be difficult to defend;
  • Whether additional factual development is needed before filing;
  • Whether the motion may affect plea negotiations; and
  • Whether raising an issue now helps the defense—or helps the government.

The purpose is not simply to file more motions. It is to identify the motions that matter and present them in a way that advances the broader defense strategy.

Discovery Review and Case Analysis

Discovery often reveals as much through what is missing as through what has been produced.

Ashleigh reviews discovery with an understanding of how investigators and prosecutors ordinarily develop a case, document their work, and prepare materials for prosecution.

She can help identify:

  • Missing reports, recordings, photographs, or attachments;
  • Investigative steps that appear incomplete;
  • Inconsistencies among witness statements;
  • Gaps between the investigative file and the prosecution’s theory;
  • Evidence that may exist but has not been disclosed;
  • Forensic or technical issues requiring closer review; and
  • Areas where additional investigation may strengthen the defense.

Different agencies investigate, document, and disclose cases differently. Knowing what ordinarily should be in the file can help counsel identify what requires follow-up and what may have gone wrong.

Jury Instructions and Trial Preparation

Ashleigh and her team assists with the preparation of customized jury instructions and trial strategy support designed to sharpen legal clarity and improve case presentation. Small distinctions in wording can significantly affect how jurors interpret legal standards, burdens of proof, and factual disputes.

The defense and prosecution may look at the same evidence and assign importance to entirely different facts.

Ashleigh helps counsel evaluate the case from the government’s perspective, including:

  • How a prosecutor may assess witness credibility;
  • Which facts may drive charging decisions;
  • What may affect plea authority;
  • Which issues may be viewed as aggravating or mitigating;
  • Where the prosecution may believe it has leverage;
  • What may cause concern about trial risk; and
  • How the defense can present its position in a way the prosecutor is more likely to understand.

This review can be particularly useful before a charging decision, before a significant plea discussion, or when negotiations have stalled.  This different perspective can be especially useful when the defense needs to anticipate how the prosecution will organize and present a complicated case to the jury.

Plea Strategy and Prosecutorial Communications

Effective negotiation requires more than identifying the desired outcome. It requires understanding what the prosecutor needs to hear, what concerns may be driving the government’s position, and where meaningful leverage may exist. Drawing on longstanding professional relationships and prosecutorial experience, we can help evaluate negotiation leverage, assess exposure, and position cases more effectively during discussions with prosecutors or investigative agencies. Where appropriate, we may also communicate directly with law enforcement officers, agents, or investigators involved in the case.

At the request of lead counsel, Ashleigh may also assist with communications involving prosecutors, investigators, law-enforcement agencies, or other government personnel when her understanding of the most effective way to frame a defense position in ways a prosecutor will accept and understand can help move the discussion forward.

The service is based on strategy, preparation, and credibility—not access or influence.

Regional Agency Relations

Effective advocacy in Northern Virginia often hinges on knowing how local law enforcement and federal agencies operate across jurisdictional lines. Our consulting framework leverages decades of professional interaction with the Fairfax County Police Department, Virginia State Police, state investigators, and regional federal agents and task forces.

Ashleigh understands how these specific agencies compile investigative files, what local deviations tend to occur during discovery collection, and how to structure communications that resonate productively with prosecutors handling high-stakes matters in local and federal courts.

Investigative Strategy and Support

Ashleigh’s team can coordinate with investigators or assist firms in developing an investigative strategy for complex or sensitive cases. Her experience also includes integrity checks and memory-recall interview work involving government agencies and serious criminal investigations. These situations demand discretion, strategic judgment, and an understanding of both investigative procedure and negotiation dynamics in high-exposure case.

It is a practical decision when the stakes are high, the discovery is extensive, or the legal issues require deeper analysis.

Our consulting services are designed to work collaboratively and discreetly alongside defense counsel. Some attorneys engage us for a limited strategic consultation. Others rely on ongoing support throughout negotiations, motion practice, discovery review, or trial preparation.
